The Risks of 1099 Contractors Working in CCRCs

Continuing Care Retirement Communities (CCRCs) are designed to offer seniors a safe and supportive environment, with different levels of care available as their needs change. However, a growing concern is the use of 1099 independent contractors caregivers who work in CCRCs but are not employed by them. This setup can bring several risks for residents, families, and the CCRC itself.

1099 workers are self-employed, which means they aren’t directly supervised by the CCRC or a licensed agency. As a result, they may not go through proper background checks, may lack consistent training, and often don’t carry adequate liability insurance. If something goes wrong, like a safety issue or medical error, it can be unclear who is legally or financially responsible.

This situation can also put the CCRC at risk. Allowing independent caregivers to operate inside the facility without proper oversight or agreements may violate state regulations or healthcare standards. It could lead to fines, legal issues, or damage to the community’s reputation.

For residents and their families, the greatest concern is quality of care. Without oversight, there’s no guarantee the caregiver is reliable or qualified. That’s why partnering with a licensed home care agency is a much safer choice.
